Legislators file an appeal to the Supreme Court to eliminate taxes on sanitary pads and tampons

#This #Monday, a group of 169 legislators from different political forces in the #Congress of the #Union, accompanied by different groups from civil society, filed an action of unconstitutionality ante la #Supreme #Court of #Justice of the #Nation so that eliminate #Value #Added #Tax (VAT) on all menstrual hygiene products.

The federal deputy of #Movimiento #Ciudadano, #Martha #Tagle reported on this challenge that was presented and said that now it will be up to the #Supreme #Court to decide on “menstrual justice and tax equity” so that a tax policy with a gender focus is achieved.

#In an attached document, the organization ##MensesDignifiedMexico announced that it supports the unconstitutionality action that 34% of the deputies presented against the VAT rate of 16% on menstrual management products.

#Through its #Twitter, said organization said that access to towels, tampons and cups is of vital importance for the rights of girls, adolescents, women and menstruating people.

“#Thanks to this action, it will be up to @scjn to decide on menstrual justice and tax equity to achieve a tax policy with a gender focus # #MenstruationLibreDeImpuestos,” the organization posted.

#In the approval of the #Income #Law, various banks, including #Morena, presented a modification proposal so that these products are not taxed, #However, the majority of the #Fourth #Transformation, prevented it, therefore, #In 2021, taxes will continue to be charged on towels, tampons and sanitary cups.

#It should also be remembered that on #September 8, the #Citizen #Movement benches, PAN, PES, PES, #Morena and the PT presented an initiative to modify article 2º.-A of the #Value #Added #Tax #Law and that there is no tax on disposable and cloth sanitary pads; as well as tampons, panty liners, cups or any other good intended for menstrual management.

#In the document presented at the #Parliamentary #Gazette and presented by the MC deputy, #Martha #Tagle, is described as a proposal that is part of a broader strategy promoted by the collective # #MenstruationDignaMéxico so that menstrual management is seen as a public issue that must be incorporated into public policies to create structural conditions that allow all women, girls, adolescents and other menstruating people in #Mexico to live it with dignity.

#And it is divided into three lines of action: 1) free menstrual management products, 2) elimination of VAT on these products, and 3) generating research and data on menstrual management in #Mexico.

“#Menstruation is a physiological process that women experience, girls, adolescents for about 40 years of our life. #That is, more than 50% of the population of our country requires products to manage menstruation on an average of 3 to 5 days each month. The ability to access products for menstrual management, as well as access to drinking water services and adequate spaces to manage menstruation in a safe way, affects the freedom to study, work and stay healthy, ”explained #Martha #Tagle.

The MC legislator defined that not having products available to manage menstruation, menstrual and reproductive education, as well as facing obstacles to access water and sanitation, and specialized medical care, coupled with the social stigma around menstruation, places millions of women in a condition of menstrual poverty.

#He explained that on average, a woman spends 720 pesos a year on sanitary napkins, the equivalent of 5% of the spending of the households of the poorest decile in the country. The situation of poverty in which 4 out of 10 women in #Mexico live makes it difficult for them to have access to dignified menstrual management. The women living in poverty spend 2.5 times more on menstrual management products than the richest 10% of the population.
