Set up on a very large scale during confinement, remote work (or telework) is once again a topic of discussion between social partners. On the initiative of Medef, trade unions and employers launched a series of meetings on Friday 5 June on this form of activity organised outside the employer’s premises. The exercise follows the obvious: at the end of March, at the height of the health crisis, one in four employees was practising their profession, according to a survey by the Directorate of Research, Studies and Statistics (Dares). And there are still hundreds of thousands of people doing this.
A new situation that raises many questions: are there opportunities opening up, for business leaders as well as for their staff? What are the difficulties? What would be improved if an experience similar to the one experienced from March 17 to May 11 were to happen again?
In a letter sent on 14 May to his employers’ and trade union counterparts, Geoffroy Roux de Bézieux, Medef’s number one, called on them to “collectively conduct diagnostic work”. With the idea of achieving, if possible, “bring a parity position into public debate”. But the letter in question did not at any time mention the intention to negotiate a national inter-professional agreement (ANI), with rules that could be imposed on all employers.
A state of mind that was reaffirmed on Friday by the employers. For Hubert Mongon, Medef’s representative, “There is room for a consistent and demanding social dialogue, but not one that is intended to lead to a normative framework”. “The urgency is not to redo the law but to think together to have a clear vision of what employees and companies have been through and to provide them with benchmarks”Believe.
For periods when the economy is running normally, the current texts do not need to be reviewed, explains, in essence, Eric Chevée, vice-president of the Confederation of Small and Medium-sized Enterprises. The development of new measures, “exceptional circumstances” containment, is, at the very least, conceivable, “but it can only be said after diagnosis”, he adds.
A position that the confederations of employees regret: in their view, the current provisions deserve to be updated. Catherine Pinchaut (CFDT) believes that“an agreement would be mouthful in the period” : “You need a framework and benchmarks, she pleads. We have a very strong demand from our activists. » “It might be interesting to complete the 2005 ANI on telework, which is still in force, observes Eric Courpotin (CFTC). But the management does not see it that way, so we wonder about the meaning of his approach. »
